Howling Heroes Collectibles LLC operates this store under the name Howling Heroes Collectibles. The terms “we,” “us,” and “our” refer to Howling Heroes Collectibles LLC.

We operate this website and store, including all related information, content, features, tools, products, and services, to provide customers with a curated collectibles shopping experience. These offerings are collectively referred to as the “Services.”

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They include important information about your legal rights, warranty disclaimers, limitations of liability, order requirements, and dispute responsibilities.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy, which is available through our website footer. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

SECTION 1 – ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence. You may permit minor dependents to use the Services only under your supervision and through devices or accounts that you own or manage.

To browse our store, create an account, or purchase products, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address.

You represent that all information you provide is accurate, current, and complete and that you have the legal authority to provide and use that information.

You are responsible for protecting your account credentials and for all activity conducted through your account. You may not sell, transfer, assign, or license your customer account to another person.

SECTION 2 – PRODUCTS AND COLLECTIBLE CONDITION

We make reasonable efforts to accurately photograph and describe every product offered through the Services. However, colors and product appearance may vary depending on your device, display settings, lighting, and other factors outside our control.

Many products sold by Howling Heroes Collectibles are vintage, pre-owned, limited-edition, discontinued, factory-sealed, or otherwise collectible. These products may have age-related wear, shelf wear, package wear, manufacturer variations, factory imperfections, or other condition characteristics.

Customers are responsible for reviewing all product photographs and reading the entire product description before purchasing. Photographs form part of the product description.

Known material defects or condition concerns will be photographed or disclosed when reasonably identifiable. Minor imperfections visible in photographs are considered disclosed, even if they are not individually listed in the written description.

We do not guarantee that a product’s appearance, packaging, condition, market value, collectibility, or future resale value will meet a customer’s personal expectations.

Product descriptions, availability, pricing, and quantities may be changed without notice. We reserve the right to discontinue products or limit quantities offered to any person, household, geographic region, or jurisdiction.

SECTION 3 – ORDERS

Submitting an order constitutes an offer to purchase. We reserve the right to accept, reject, limit, or cancel an order for any lawful reason.

An order is not considered accepted until payment has been authorized and we confirm the order. We may contact you using the email address, telephone number, billing information, or shipping information provided during checkout if an order requires clarification.

Please review your order carefully before submitting it. Orders may enter packing or fulfillment preparation shortly after they are placed, and cancellation requests are not guaranteed.

Purchases are subject to our published Return and Refund Policy, available through our website footer.

We may cancel or limit orders that appear fraudulent, unauthorized, improperly priced, intended to evade purchase limits, associated with payment disputes, or otherwise present an unreasonable risk to the business or our customers.

If we cancel an order before shipment, any payment collected for the canceled portion will be refunded to the original payment method.

SECTION 4 – PRICES, BILLING, AND TAXES

Prices, promotions, discounts, and product availability are subject to change without notice.

The price charged will be the price displayed when the order is submitted, subject to correction of clear errors. Unless expressly stated otherwise, displayed product prices do not include shipping charges, taxes, customs charges, import fees, or other government assessments.

Prices offered through our Shopify store may differ from prices offered through eBay, vendor events, social media, marketplaces, or other sales channels.

Promotions may have separate conditions. If promotion terms conflict with these Terms, the specific promotion terms will control for that promotion.

You agree to provide accurate and complete payment, billing, shipping, and account information. You agree to promptly update information necessary for us to process your order or contact you.

You represent that:

  1. The payment information you provide is accurate and complete.

  2. You are authorized to use the selected payment method.

  3. Charges made using that payment method will be honored.

  4. You will pay all applicable product, shipping, handling, and tax charges associated with your order.

SECTION 5 – SHIPPING AND DELIVERY

We ship orders using the shipping service selected or made available during checkout.

Shipping and delivery dates are estimates and are not guarantees. We are not responsible for carrier delays, weather events, natural disasters, service disruptions, incorrect customer addresses, customs delays, or other circumstances outside our reasonable control.

Customers are responsible for entering a complete and accurate delivery address. Additional shipping charges resulting from an incorrect, incomplete, or undeliverable address may be charged to the customer where permitted.

Customers must promptly report packages that appear lost, damaged, incorrectly delivered, or materially delayed.

Claims involving packages lost or damaged during shipment will be handled according to our Shipping Policy and Return and Refund Policy.

Customers must retain the item, shipping box, shipping label, packing materials, and all other contents while a claim is being reviewed. Customers must provide any photographs, documentation, statements, or carrier cooperation reasonably requested to investigate the claim.

Customers must not discard, alter, repair, open, or return a damaged collectible without instructions from Howling Heroes Collectibles.

SECTION 6 – RETURNS, REFUNDS, AND FINAL SALES

All sales are final except where otherwise required by applicable law or expressly stated in our Return and Refund Policy.

We do not accept returns, exchanges, or refunds for buyer’s remorse, accidental purchases, changes of mind, ordering the wrong item, changes in collectible value, or dissatisfaction with conditions that were shown or disclosed in the product listing.

Items sold as factory sealed cannot be returned after the seal or packaging has been opened, altered, removed, or damaged.

If an order arrives damaged, contains the incorrect item, or is materially different from its listing, the customer must contact us within the timeframe and follow the documentation requirements stated in our Return and Refund Policy.

Submitting a claim does not automatically guarantee a refund, replacement, exchange, or partial refund. Claims are reviewed individually based on the product listing, order records, shipment tracking, photographs, packaging, and other relevant evidence.

Nothing in these Terms limits rights that cannot legally be excluded.

SECTION 7 – INTELLECTUAL PROPERTY

The Services and their original content—including our branding, logos, mascot artwork, Ghostclaw materials, graphics, photographs, text, slogans, page designs, videos, audio, and other creative material—are owned by Howling Heroes Collectibles LLC or used under an applicable license.

These materials are protected by United States and international copyright, trademark, and other intellectual-property laws.

You may access the Services for personal, noncommercial shopping purposes. Unless we provide prior written permission, you may not copy, reproduce, modify, publish, distribute, display, sell, license, scrape, download, or create derivative works from our original content.

“Howling Heroes Collectibles,” “Ghostclaw,” associated logos, designs, slogans, and other identifiers are brand assets of Howling Heroes Collectibles LLC. Their appearance on the Services does not grant permission for their use.

Shopify’s names, logos, products, and services belong to Shopify or its licensors. Other names, products, logos, and trademarks belong to their respective owners.

All rights not expressly granted are reserved.

SECTION 8 – OPTIONAL TOOLS

We may provide access to tools or features operated by third parties. We do not necessarily monitor, control, or endorse those third-party tools.

Third-party tools are provided on an “as is” and “as available” basis, subject to the terms and policies of their providers.

Use of optional third-party tools is at your discretion and risk. You are responsible for reviewing and accepting the terms governing those tools before using them.

New tools, features, and resources added to the Services may also be subject to these Terms.

SECTION 9 – THIRD-PARTY LINKS

The Services may contain links, content, embedded features, or materials provided by third parties.

We are not responsible for evaluating or guaranteeing the accuracy, security, availability, or practices of third-party websites or services.

If you leave our Services to visit a third-party website, you do so at your own discretion and risk. Review the third party’s terms and privacy practices before providing information or completing a transaction.

Questions or complaints concerning third-party products or services should be directed to the applicable third party.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Howling Heroes Collectibles is powered by Shopify, which provides the ecommerce platform supporting the Services.

Sales made through our store are transactions directly between the customer and Howling Heroes Collectibles LLC.

Shopify is not the seller of the collectibles offered through our store and is not responsible for product descriptions, product condition, packaging, fulfillment, delivery, returns, refunds, or other aspects of transactions between customers and Howling Heroes Collectibles LLC.

To the extent permitted by law, you release Shopify and its affiliates from claims arising solely from products purchased directly from Howling Heroes Collectibles LLC.

SECTION 11 – PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy, available through our website footer.

Certain personal information may also be processed according to Shopify’s Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes certain information relating to your access to and use of the Services.

Information submitted through the Services may be transmitted to Shopify and other service providers as necessary to operate the store, process payments, fulfill orders, prevent fraud, provide customer support, and comply with legal obligations.

You represent that your submission:

  3. Does not contain malicious code, viruses, or harmful material.

  4. Accurately discloses any compensation or incentive associated with a review or endorsement.

We may monitor, edit, decline, or remove submissions that violate these Terms or that we reasonably consider unlawful, harmful, fraudulent, or inappropriate.

We are not obligated to keep unsolicited feedback confidential, compensate the person providing it, or implement any submitted idea.

SECTION 13 – ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccurate information, or omissions concerning product descriptions, photographs, condition, pricing, promotions, shipping charges, transit times, availability, or other information.

We reserve the right to correct errors, update information, or cancel an affected order when information is materially inaccurate.

If we cancel an order because of a pricing, inventory, or listing error, amounts collected for the canceled portion will be refunded to the original payment method.

You may use the Services only for lawful purposes.

You may not use the Services to:

  1. Violate any applicable law, regulation, ordinance, or legal right.

  2. Infringe intellectual-property, privacy, publicity, or proprietary rights.

  6. Manufacturer packaging will be free from every minor factory or shelf imperfection unless expressly stated.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

SECTION 18 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Howling Heroes Collectibles LLC and its owners, employees, contractors, service providers, affiliates, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or purchase of a product.

This includes, where permitted, lost profits, lost revenue, lost savings, loss of data, loss of anticipated collectible value, loss of resale opportunity, replacement costs, or similar damages.

Nothing in these Terms excludes liability that cannot legally be excluded.

If applicable law does not permit a complete limitation of liability, liability will be limited to the greatest extent permitted by that law.

SECTION 19 – INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Howling Heroes Collectibles LLC, Shopify, and their respective affiliates, owners, directors, officers, employees, contractors, agents, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal expenses arising from:

  1. Your material breach of these Terms.

  2. Your violation of applicable law.

  3. Your infringement of another party’s rights.

  4. Your unlawful or unauthorized use of the Services.

  5. Content or information you submit through the Services.

We will provide reasonable notice of an indemnifiable claim when practicable. You agree to reasonably cooperate in the defense of the claim.

The remaining provisions will remain valid and enforceable.

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and other policies posted through the Services, constitute the agreement between you and Howling Heroes Collectibles LLC concerning use of the Services.

If a store policy specifically addresses a matter and conflicts with a general provision of these Terms, the more specific store policy will control to the extent permitted by law.
